Britney Spears Still ‘Under Investigation’ After Arrest for Drugs and Alcohol DUI

Britney Spears is still under investigation following her DUI arrest near her home in Ventura County, California.

Us Weekly has learned that chemical examination results from Spears’ field sobriety tests on Wednesday, March 4, are pending and could impact the scope of an ongoing police investigation. Spears’ Black BMW 430i was pulled over on the 101 Freeway late Wednesday and police reportedly observed that she exhibited signs of impairment during a roadside investigation.

Spears, 44, was ultimately arrested on suspicion of driving under the influence of a combination of drugs and alcohol on Wednesday night and subsequently booked into Ventura County Main Jail on Thursday, March 5, at 3:02 a.m.

Per TMZ, Spears was transported to a local hospital by California Highway Patrol officers to test her blood alcohol limit, which was determined to be under the legal limit at .06. Spears was eventually released at 6:07 a.m. local time, Us confirmed.

Ventura County Sheriff’s Office online records show that a court hearing has been set for Monday, May 4 — exactly two months after Spears’ arrest.

Spears posted multiple dancing videos prior to her arrest on Wednesday, but her Instagram account has seemingly been deactivated. Her spokesperson described the arrest as “an unfortunate incident that is completely inexcusable” in a statement to Us.

“Britney is going to take the right steps and comply with the law, and hopefully this can be the first step in long overdue change that needs to occur in Britney’s life,” her rep added. “Hopefully, she can get the help and support she needs during this difficult time.”

Per her rep, Spears plans to “spend time” with her sons, Sean Preston Federline and Jayden James Federline, in the aftermath of her arrest.

“Her loved ones are going to come up with an overdue, needed plan to set her up for success for well-being,” her rep added.

Earlier on Thursday, an insider told Us that Spears’ loved ones viewed her DUI arrest as a potential “a wake-up call for her” following a difficult few years.

Britney’s father, Jamie Spears, placed her under a conservatorship in 2008 following her divorce from ex-husband Kevin Federline. The “Toxic” singer lived under that conservatorship for more than 13 years before it was legally dissolved in 2021.

“My voice was muted and threatened for so long and I wasn’t able to speak up or say anything and because of you guys [her fans] and the awareness of kind of knowing what was going on, and delivering that news to the public for so long, you gave awareness to all of them [in the legal system],” she said in a November 2021 video about the end of her conservatorship.

Britney married her third husband, Sam Asghari , in June 2022, but their union was short-lived. The singer announced her split from Asghari, 32, in August 2023 in a since-deleted Instagram post. (Britney’s first marriage to childhood sweetheart Jason Alexander was annulled in 2004.)

“As everyone knows, Hesam and I are no longer together,” Britney wrote via Instagram on August 18, 2023. “6 years is a long time to be with someone so, I’m a little shocked but … I’m not here to explain why because its honestly nobody’s business !!! But, I couldn’t take the pain anymore honestly !!!”

More recently, Britney condemned her second husband, Federline, 47, for writing a tell-all memoir about their marriage.

“With news from Kevin’s book breaking, once again he and others are profiting off her, and sadly it comes after child support has ended with Kevin,” her spokesperson told Us last October. “All she cares about are her kids, Sean Preston and Jayden James, and their well-being during this sensationalism.”

Federline told Us that same month that he was “entitled” to share his “perspective” on his and Britney’s marriage.
