A dessert and cocktail bar has won the right to reopen after being locked out by a major Brisbane developer for planned demolition.

Graya lodged plans for a five-storey apartment building at 63-71 Racecourse Road in Hamilton last year, to be called “The Gallery”.

It owns the lands, which is presently a shopping hub. Most existing businesses were closed and fenced off in early April ahead of the existing buildings being torn down.

Krazy Dessert Hamilton – which had its locks changed and power cut on April 1 – argued at the time they had a clause protecting them from eviction for the purpose of demolition until 2030, and promised to pursue legal action.

On Friday morning the Supreme Court granted a temporary injunction allowing the shop to reopen for 10 days as legal proceedings continued.

“We are now working to reopen as soon as possible and look forward to welcoming our customers back,” the business said in a statement on Friday.

The developer told this masthead it remained confident in its plans for the site.

“Graya’s position remains the same – and that is that the lease was lawfully terminated,” a spokesperson said.

“Sixteen of the seventeen businesses in the existing building worked with us through this process.

“The interim orders while surprising, are temporary, and we look forward to presenting our full position through the appropriate legal process.”

Works by Graya to prepare the site for demolition continued on Friday.

Plans lodged with Brisbane City Council in 2025 show the proposed development would comprise 37 units and have an arcade linking through to Kent Street.

Brisbane City Council confirmed no development application was required for demolition works on the site, but the developer did need building approval from a private certifier.
