Timothy Busfield Asks Judge to Dismiss Grand Jury Indictment in Child Sex Abuse Case

Timothy Busfield Asks Judge to Dismiss Grand Jury Indictment in Child Sex Abuse Case

Timothy Busfield and his attorneys continue to fight back against child sex abuse allegations surrounding the actor.

According to online court records viewed by Us Weekly on Thursday, June 18, Busfield’s team filed a motion to quash a grand jury indictment.

The actor asked a judge to toss the indictment because the state of New Mexico has “abdicated its role in administering justice” and is blindly pursuing an indictment against him, according to documents first obtained by TMZ.

Busfield, 69, said he decided to testify in his own defense in front of the grand jury, but claims he was treated unfairly by the prosecutor.

The actor also argued that prosecutors are aware of an independent investigation into the allegations against him conducted by Warner Bros. (The actor says they found nothing to back the allegations.) Prosecutors, however, have chosen to ignore the alleged findings, Busfield and his team claim in documents.

A status hearing and conference is scheduled for Tuesday, June 30. Us has reached out to Busfield’s attorney for comment.

Busfield was first indicted on child sex abuse charges by a grand jury in New Mexico on February 6. The actor was specifically indicted on four counts of criminal sexual contact of a child, the Bernalillo County District Attorney’s office said in a press release obtained by Us. 

“As with all criminal proceedings, Mr. Busfield is presumed innocent unless and until proven guilty in a court of law,” Bernalillo County District Attorney Sam Bregman said in a statement via Facebook. “This case will proceed through the judicial process and is expected to move forward to trial.”

Busfield’s attorney later released a statement maintaining his client’s innocence.

“The indictment was not unexpected. As the saying goes, a grand jury will indict a ham sandwich, the statement read. “What is deeply concerning is that the District Attorney is choosing to proceed on a case that is fundamentally unsound and cannot be proven at trial. The detention hearing exposed fatal weaknesses in the State’s evidence — gaps that no amount of charging decisions can cure. This prosecution appears driven by something other than the facts or the law. Mr. Busfield will fight these charges at every stage and looks forward to testing the State’s case in open court — where evidence matters — not behind closed doors.”

Busfield — who has pleaded not guilty to the charges — was accused of touching a child actor inappropriately in incidents that allegedly occurred between late 2022 and early 2024, according to the Albuquerque Police Department affidavit obtained by Us.

In an interview with police during the investigation, Busfield denied that there was anything “weird” about his interactions with the children on set, according to the criminal complaint.

“He didn’t do anything wrong,” Busfield’s attorney previously said in a statement to NBC News. “These accusations are false as the investigator from the independent law firm found.”
