Driver who struck and killed jogger in front of his wife sues victim’s family for his emotional damage

A driver who struck and killed a jogger in front of his wife last year is now suing the man’s family, claiming he now suffers from post-traumatic stress disorder.

Gavin Maas, 25, hit and killed Anthony Miller, a 37-year-old father of two and award-winning nurse, while he was on an early morning run with his wife, Bailey Miller, in August.

Maas said he moved to give Bailey Miller room when he saw her reflective clothing — but didn’t see her husband, who was wearing dark clothing in the dark and rain, according to a police report.

Maas — who immediately stopped his vehicle to attempt life-saving measures — was not given a citation for the deadly accident, which was blamed in part on the poor lighting and weather.

However, the driver said he has since been hospitalized numerous times due to the emotional damage the crash caused — and is seeking $50,000 in damages from Miller’s family to cover his medical costs and lost income, KOLN reported.

Miller was a Daisy-award-winning trauma nurse at Nebraska Medical Center who was helping his wife train for a local half-marathon when he was struck and killed.

He was also a great “girl dad” to their two young daughters, Annalise and Keely, according to his wife of seven years.

“The biggest honor for him was to be a dad,” his widow said. “He loved our girls so much.”
